9.      Restitution of Conjugal Rights

PART – B (2 x 18 = 36 Marks)

Answer any TWO of the following questions:

11.  Discuss various Constitutional limitations of women reservations in Legislature and Constitutional bodies.

12.  Explain the daughters’ rights to property under the Hindu Succession Act, 1956 and also under the Hindu Succession (A.P. Amendment) Act, 1986.

13.  Write the protective provisions relating to women labor under various Labor Legislations.

14.  Write the significance and the salient features of PITA.

PART – C (2 x 20 = 40 Marks)

Answer any TWO of the following questions:

15.  Mrs. A, who is a divorcée, went to a Bank to open a Bank Account in the name of her minor son. The Bank objects saying that the Bank Account can be opened only by the Guardian of the minor and as long as the father is alive, he alone is recognized as the natural guardian. Advise Mrs. A.

16.  X and Y wanted to get married but postponed it as X did not have any job and also Y’s family members were not willing for the marriage. One day, X took Y into the pooja room, put sindhoor on her forehead and told her that they were legally married. Thereafter, they lived together. Few days later, X got a job and now he denies his marriage with Y. Y’s parents filed a case against X on the charges of cheating and rape. Discuss.

17.  A tortured his wife B and made a number of attempts to murder her in order to get more money from her parents. She deserted him and took shelter in her parents’ house. Advise her as to the available remedies in this regard.

 

18.  A is a working woman in a private company. One Mr. X, who is the manager of the company indecently depicted her photograph and exhibited it to the public without her consent and knowledge to get more sales in the market. A wanted to file a suit against X. Advise A.
